Contested divorce Utah is a divorce where some aspect of the divorce is disputed by one of the spouses. Often these disputes are over the division of property, debt, or other marital assets; however, the dispute can be over the divorce itself. A contested divorce is much more complicated than uncontested divorce because an entire trial is needed in order for the court to resolve disputes. Contested divorce comes with other consequences such as a much longer divorce period, higher legal fees and court fees, and increased stress. Whenever possible, it is recommended that spouses try to resolve conflicts out of court. n any event the attorneys at Wall & Wall provide high-quality legal representation so their clients’ best interests are protected.

An uncontested divorce in Utah is a divorce in which both spouses agree to divorce, and are able to settle divorce agreements outside of court. Uncontested divorces, also known as Flat Rate Divorces, are often preferable to contested divorce because they are less expensive and are often quicker. Uncontested divorces are not for everyone, but because they offer advantages, most divorces are uncontested. Though disagreements are settled outside of court, it does not mean that there are no disagreements, instead that these disagreements are resolved by the spouses themselves, or through a mediator. No divorce is finalized without a court order, but because uncontested divorces are already agreed upon by both spouses, the paperwork can typically be filed without a court appearance.

One of the most drastic negative impacts that divorce has on our culture is violence and abuse. Whether before a divorce or during, domestic violence is a serious issue that can effect divorce proceedings. If you are facing any type of abuse during a divorce, consult with your attorney to utilize the legal process for protection.
Utah law requires divorcing spouses go through mediation, and having an attorney to advise you on your legal rights is imperative. Divorce mediators are there to get parties to come to an agreement and cannot give legal advice. Attorneys will help ensure that all areas of the family are mitigated correctly according to the law, ensuring there will be fewer disagreements in the future. This will save you time and future legal costs for your family.

Same-Sex Parental Adoptions and Surrogacy – The Supreme Court’s decision regarding same-sex marriage appeals from the 10th Circuit District Court legally enabled same-sex couples to have a child via adoption or surrogacy in Utah. We can ensure that both same-sex parents have equal rights to the child.

Fair and equitable distribution of all marital assets and debts occurs when a couple divorces in the state of Utah. Whether one party has made significant financial contributions to the marriage, or one partner has recently inherited a large sum of money, the courts determine what fair distribution is when the marriage is being dissolved. Debts are also divided fairly. If one party entered the marriage with a large amount of debt, that same person is likely to be responsible for that debt if it still exists at the end of the marriage. The Utah courts have considerable leeway when dividing marital property, and it’s critical to have a qualified family law attorney on your side. If you are in the midst of a divorce, it’s time to fill out our contact form to see what we can do for you. We offer a no-obligation case review, and we understand the emotional complexities that come with filing for divorce. We are here for you and we will protect your rights as you go through the difficult process of divorce.
Guardianship is a legal arrangement that places an individual, also known as a "ward" or "protected person", under the supervision of a guardian, or custodian. In Utah, a guardian primarily has the court-appointed power to provide for the physical well-being of a protected person and a conservator is the court-appointed individual or entity to provide for the financial well-being of the protected person.
A guardian is typically a family member, friend, or fiduciary appointed by the court. A protected person can be a minor without a parental guardian or an adult who can no longer make safe and sound decisions about his or her own person or property. Additionally, a person may be placed under guardianship who is prone to fraud or undue external influence. In Utah, we have a statute (or law) that governs who has priority to serve as guardian or conservator for a protected person. For example, the agent named in the protected person's Utah Advance Directive will normally have priority to serve. Lacking that nomination, a spouse or adult child may be an appropriate person to serve.
While guardianship does attempt to maintain the protected person’s independence, it should only be considered inappropriate cases, as it may significantly impinge upon rights of the individual. In fact, in our state, limited guardianships/conservatorships are actually preferred. A full guardianship is granted only in the case where the judge makes a specific finding that no limitations should be placed on the guardian.

Paternity actions are similar to divorce actions with the underlining difference that the two parties have never been married but have children together. It is very important to have a Paternity decree filed with the court to define the relationship between the parties and their child/children. Below are some possible scenarios that would fit into the category of a paternity action and explanations of why it is important to have a fathers rights attorney Utah draft a formal Paternity Decree with the court.
If a guy suspects that he may be the father of a child and doesn’t file or sign a voluntary acknowledgment of paternity within 30 days of the birth of the child, the mother has the right if she chooses to place the child up for adoption without giving any notice to the father. A paternity suit can be filed by a fathers rights attorney in Utah before a child is born to preserve your rights. Call Today!
Utah courts use custody evaluations to make decisions about children’s best interests during custody disputes. Such evaluations sometimes are necessary in divorces but may occur in other situations, such as with parents who have never been married and may not have lived together. Custody disputes also can arise after years of co-parenting, for instance, if one parent needs to move for employment reasons.
Child custody evaluations provide Utah courts with the information needed to make decisions about where and with whom a child will live, who will make decisions in the child’s life, whether custody will be sole or joint, what the level of access for each parent will be, and other details.
The evaluations are conducted by court-appointed evaluators — psychologists, social workers, physicians or licensed counselors — who gather information through interviews, home visits, psychological testing and other means. As court-appointed evaluators, these professionals are not working for either side but are the court’s experts tasked with the responsibility of advising the court on what is in the best interests of the child.
